By downloading or using Nexiter LIVE, you agree to these terms.

1. What the App Does

Nexiter LIVE reads live telemetry data from your BMW or MINI vehicle via BMW's CarData API (MINI uses the same system) and forwards it to A Better Route Planner (ABRP) to improve route planning accuracy.

2. No Affiliation with BMW or ABRP

This app is an independent tool created by a third-party developer. It is not affiliated with, endorsed by, authorised by, or supported by:

• BMW Group or any BMW entity (including MINI)
• Iternio AB (the company behind A Better Route Planner)

BMW, MINI and ABRP are trademarks of their respective owners.

3. Third-Party API Disclaimer — Important

This is the most important section. Please read it carefully.

This app relies on APIs (programming interfaces) provided by BMW and ABRP. These companies can change, restrict, or discontinue their APIs at any time and without notice.

If BMW or ABRP changes their APIs, this app may stop working — partially or completely — until an update is released. In some cases, an update may not be technically possible.

The developer:

• Is not responsible for any changes BMW or ABRP make to their services
• Will make best efforts to update the app when API changes occur
• Cannot guarantee that the app will continue to function indefinitely
• Has no control over BMW's or ABRP's business or technical decisions

Historical context: BMW has previously blocked third-party API access without notice (September 2025). ABRP discontinued BMW integration via one of their data providers (November 2025). This demonstrates that such changes are real and can happen.

4. Free Trial and Payment

• The app includes a 14-day free trial with full functionality
• After the trial, a one-time payment of €9.99 unlocks lifetime access
• The trial gives you adequate time to verify the app works with your specific vehicle before committing to a purchase

Refund policy:

• Refunds for technical issues within the developer's control: contact the developer
• No refunds for service disruptions caused by BMW or ABRP API changes — these are outside the developer's control and are disclosed in advance in this document
• No refunds for inability to use the app because you are not the vehicle's main user — this requirement is disclosed before purchase; please use the free trial to confirm CarData access works for your account
• Google Play's standard refund policy applies within 2 hours of purchase

5. Your Responsibilities

You are responsible for:

• Being the main (primary) user of the vehicle in your BMW account. BMW CarData is not available to joint/secondary users — if you are not the main user, the app cannot function. This requirement is disclosed before purchase (in the app's Welcome and disclaimer screens and in the setup guide).
• Having valid BMW (My BMW / MINI) and ABRP accounts
• Creating your own BMW CarData client credentials
• Complying with BMW's and ABRP's terms of service for your own accounts
• Not sharing your credentials with others

6. No Warranty

This app is provided "as is" without warranty of any kind. The developer makes no guarantee that it will be error-free, uninterrupted, or suitable for your specific use.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the developer is not liable for:

• Loss of data
• Service interruptions caused by BMW or ABRP
• Any indirect or consequential damages

9. Updates to These Terms

If these terms change materially, a notice will appear in the app's Play Store listing. Continued use of the app after changes constitutes acceptance of the updated terms.

10. Language

The English version of these Terms is the authoritative, legally binding version. Translations into other languages may be provided within the app or documentation for convenience only. In the event of any discrepancy or conflict between the English version and a translation, the English version prevails.

These terms are governed by the laws of Spain (EU). Any disputes shall be resolved in the courts of Barcelona, Spain.
